Question Both of my parents passed away in the same accident 8 months ago. Two years before they died they changed their home from joint tenants and added my brother as an owner. So at their death, the home was owned by all three, but the deed now says tenants in common. We are just now starting to deal with the property. Who should the property be owned by now? All by my brother? Do we need an attorney?

The property is now owned by your brother and the beneficiaries of your parents. So if your parents leave their shares to you and your brother, your brother will end up owning his initial 1/3 PLUS his share he receives from their estate.

Yes. I recommend you have an attorney to handle this because a probate will be necessary to transfer your parents' shares. Thank you.
